Summary: Council is requested to adopt the Resolution of Acceptance of bid to sell certain City owned real property identified as Assessor Parcel Number 010-610-17 located at 265 Keystone Avenue, Reno, Nevada.

 

Discussion:  At the July 31, 2019 Council meeting, Council determined that the sale of certain City owned real property was in the best interest of the public and passed Resolution No. 8698, Resolution that it is in the best interest of the City to sell certain City owned real property identified as Assessor Parcel Number 010-610-17 located at 265 Keystone Avenue, Reno, Nevada, to be sold by public auction for a minimum cash price of $1,715,000 and an agreement to develop it within 18-24 months from the close of sale in accordance with the provisions of NRS 268.059 – 268.062 and Title 15 of the Reno Municipal Code. At Council’s direction, the foregoing Resolution was passed and adopted July 31, 2019.  This is the process of accepting the highest qualified bid should Council choose to accept.

 

Financial Implications:  The expense of the appraisals, noticing, and advertising of the auction was approximately $13,901.  These expenses along with any escrow costs would be reimbursed from the sale of the property.  There is the potential that the sale of the property could generate the minimum of $1,715,000 minus any expenses.  Any proceeds will be put in the Police Station Capital Projects Fund.

 

Legal Implications:  Legal review completed for compliance with City procedures and Nevada Law.

 

Ordinance or Resolution

 

RESOLUTION OF ACCEPTANCE OF BID TO SELL CERTAIN CITY OWNED REAL PROPERTY IDENTIFIED AS ASSESSOR PARCEL NUMBER 010-610-17 LOCATED 265 KEYSTONE AVENUE, RENO, NEVADA.

 

WHEREAS, on July 31, 2019, the Reno City Council determined that the sale of the certain City owned real Property was in the best interest of the public and passed Resolution No. 8698, Resolution that it is in the best interest of the City to sell certain City owned real property identified as Assessor Parcel Number 010-610-17 located 265 Keystone Avenue to be sold by public auction for a minimum cash price of $1,715,000 and an agreement to develop the property within 18-24 months from the close of sale in accordance with the provisions of NRS 268.059 – 268.062 and Title 15 of the Reno Municipal Code. At Council’s direction, the foregoing Resolution was passed and adopted July 31, 2019.

 

              WHEREAS, the Notice of Adoption of Resolution of Intent has been properly published and posted as required by law; and,

 

              WHEREAS, _____________________________ is a responsible bidder and submitted a bid which equaled or exceeded the highest appraised value of the Property and was the highest bid substantially conforming to the terms and conditions of the Resolution of Intent; and,

 

WHEREAS, selling the Property to this bidder is in the public interest,

 

 

              NOW, THEREFORE BE IT RESOLVED that the City of Reno hereby accepts the bid in the amount of ____________________ plus costs of closing and an agreement to develop the property within 18-24 months from the close of the sale and authorizes and directs the City Manager to negotiate a purchase and sale agreement consistent with the bid solicitations and public auction proceedings.  If an agreement is not reached, the City Manager shall return to this Council for further instructions.  If an agreement is reached, the Mayor is authorized and instructed to execute the agreement and execute and deliver a deed of the City owned real property identified as Assessor Parcel Number 010-610-17 located at 265 Keystone Avenue, more particularly described in “EXHIBIT A.”  The City Manager or his/her designee is authorized and instructed to negotiate, prepare and execute all other documents necessary to complete the sale, including escrow instructions and closing certificates, and other documents necessary to convey good and marketable title.

BEGINNING at the southeast corner of said Parcel 4C;

 

THENCE southwesterly coincident with the southerly line of said Parcel 4C and the southerly line of said Parcel 4B, South 76°56'34" West, 627.75 feet to the beginning of a curve to the left, concave southeasterly, and having a 8,300.00 foot radius;
