Recommendation and Proposed Motion

Recommendation:  Staff recommends that City Council accept the donation of $25,000 from Dorothy and Chi Chi Bengochea to support the construction of the downtown dog park.

Proposed Motion:  I move to approve staff recommendation.

Staff Report Formal Body

Summary:  Dorothy and Chi Chi Bengochea donated $25,000 to support the construction of a dog park downtown.  The dog park will be located on the ReTRAC lids west of Sierra Street.  The City has committed $75,000 for the project and a group of residents are currently raising an additional $25,000 for this project.  Staff recommends the City Council accept the donation from Dorothy and Chi Chi Bengochea in the amount of $25,000.

Discussion: A group of local residents approached the City about their desire to build a dog park on the ReTRAC lids.  The City has committed $75,000 from Residential Construction Tax funds to aid in the construction of the dog park.  City staff estimates that the dog park will cost between $100k-$125k to construct.  By accepting this donation, the City will be able to move forward in the process to get construction drawings in preparation to bid the project out.  Staff estimates that construction will be finished late winter/early spring.

Financial Implications:  The funds will be restricted for the purpose in which they were donated.

Legal Implications:  Legal review completed for compliance with City procedures and Nevada Law. NRS 268.008(6) provides that the city may "Receive bequests, devises, gifts and donations of all kinds of property wherever situated in fee simple, in trust or otherwise, for charitable or other purposes and do anything necessary to carry out the purposes of such bequests, devises, gifts and donations with full power to manage, sell, lease or otherwise dispose of such property in accordance with the terms of such bequest, devise, gift or donation."
