Recommendation and Proposed Motion

Recommendation:  Staff recommends Council approval of:

1.              2016 Cooperative Fire Protection Agreement (five years) between the City of Reno, on behalf of the Reno Fire Department, the USDA Forest Service - Humboldt-Toiyabe National Forest and the USDI Bureau of Land Management - Carson City District, and authorize the Mayor to sign; and

2.              2016 Annual Operating Plan for Cooperative Fire Protection Agreement between the City of Reno, on behalf of the Reno Fire Department, the USDA Forest Service - Humboldt-Toiyabe National Forest and the USDI Bureau of Land Management - Carson City District, and authorize the Mayor to sign.

 

Proposed Motion:  I move to approve staff recommendation and authorize the Mayor to sign both the Cooperative Fire Protection Agreement and the Annual Operating Plan. 

Staff Report Formal Body

Summary:  The 2016 Cooperative Fire Protection Agreement (CFPA) and the 2016 Annual Operating Plan (AOP) for Cooperative Fire Protection Agreement reflect the manner in which cooperative fire protection is carried out during fire emergencies involving the Reno Fire Department, the USDA Forest Service – Humboldt-Toiyabe National Forest and the USDI Bureau of Land Management – Carson City District.  The 2016 CFPA and 2016 AOP replace the agreements adopted by Council on July 1, 2012 and May 27, 2015.  Staff recommends Council approval of the 2016 Cooperative Fire Protection Agreement and 2016 Annual Operating Plan for Cooperative Fire Protection Agreement.

 

Previous Council Action: 

·         July 1, 2012 – City Council approval of the Cooperative Fire Protection Agreement between the USDA Forest Service – Humboldt-Toiyabe National Forest, and the City of Reno on behalf of the Reno Fire Department.

·         May 27, 2015, April 30, 2014, July 10, 2013 and July 1, 2012 – City Council approval of the Annual Operating Plan for the Cooperative Fire Protection Agreement between the US Forest Service – Humboldt-Toiyabe National Forest, and the City of Reno on behalf of the Reno Fire Department, Reno, Nevada. 

 

·         July 1, 2012 – City Council approval of the Cooperative Fire Protection Agreement between the USDI Bureau of Land Management – Carson City District, and the City of Reno on behalf of the Reno Fire Department.

·         May 27, 2015, April 30, 2014, July 10, 2013 and July 1, 2012 – City Council Approval of the Annual Operating Plan for the Cooperative Fire Protection Agreement between the USDI Bureau of Land Management – Carson City District, and the City of Reno on behalf of the Reno Fire Department, Reno, Nevada. 

 

Discussion:  In 2016, the USDA Forest Service and USDI Bureau of Land Management combined their individual Cooperative Fire Protection Agreements and Annual Operating Agreements together to form one unified Cooperative Fire Protection Agreement, which is valid for five years and an Annual Operating Plan, replacing the individual federal agencies 2012 Cooperative Fire Protection Agreement and 2015 Annual Operating Agreement.  The Cooperative Fire Protection Agreement and Annual Operating Plan outlines common expectations, operating protocols, reimbursement rates and shared responsibilities, mutual and automatic aid parameters during wildland fires involving the USDA Forest Service – Humboldt-Toiyabe National Forest, the USDI Bureau of Land Management – Carson City District, and the City of Reno, on behalf of the Reno Fire Department.

 

Financial Implications:  This plan sets the rates in regard to billings and allows for assistance for 24 hours without reimbursement to incidents inside the jurisdictions of the City of Reno, the USDA Forest Service – Humboldt-Toiyabe National Forest and the USDI Bureau of Land Management – Carson City District.

 

Legal Implications:  The Cooperative Fire Protection Agreement and Annual Operating Plan are entered into in accordance with applicable law and are binding agreements.
